Welcome to Pytch Sports. These Terms and Conditions (“Terms”) govern your access to and use of the Pytch Sports website, mobile applications, software, products, services, and related features (collectively, the “Services”).
The Services are provided by Pytch Sports, LLC (“Pytch Sports,” “Pytch,” “we,” “us,” or “our”).
By accessing our website, creating an account, downloading or using the Pytch Sports app, purchasing a Pytch product, or otherwise using our Services, you agree to these Terms.
If you do not agree to these Terms, do not use the Services.
Pytch Sports provides electronic communication products and software designed primarily for baseball and softball teams.
Products may include, among other things:
Product features, specifications, availability, compatibility, and designs may change as our products continue to develop.
You must be legally capable of entering into a binding agreement to purchase products or create an account.
If a Pytch product or Service is used by a minor, the minor's parent, legal guardian, coach, school, organization, or other responsible adult is responsible for supervising that use.
Certain Services may require a Pytch account or connection to a Pytch device.
You are responsible for maintaining the confidentiality of your account credentials, device passwords, Team IDs, and other security information.
Some Pytch devices may ship with a temporary or default password. You should change any default password immediately after initial setup.
You are responsible for activity performed through your account or authenticated devices unless prohibited by applicable law.
Notify Pytch Sports promptly if you believe your account, password, or device has been compromised.
All orders are subject to acceptance and product availability.
We reserve the right to refuse or cancel an order when reasonably necessary, including because of:
If we cancel an order after payment has been collected, the applicable amount will be refunded.
Prices are displayed in U.S. dollars unless otherwise indicated.
Applicable taxes, shipping charges, and other charges may be added during checkout.

Customers are responsible for providing accurate shipping information.
Returns and refunds are governed by the Pytch Sports Return and Refund Policy in effect at the time of purchase.
Products returned to Pytch Sports must satisfy the requirements of that policy.
Nothing in these Terms limits any return, refund, or other consumer right that cannot legally be waived.
Pytch products are electronic devices and should be used according to their instructions and intended purpose.
Users should not:
Unauthorized modification, improper repair, misuse, or damage may affect warranty coverage to the extent permitted by law.
Pytch products use wireless communication to transmit information between compatible devices.
Wireless performance can be affected by distance, physical obstructions, interference, antenna orientation, radio-frequency conditions, battery level, device configuration, and other environmental factors.
Any stated communication range represents expected or tested performance under particular conditions and is not a guarantee that the same range will be achieved in every environment.
Users should confirm proper operation before games, practices, or other important events.
Pytch X5 watches are designed to display compatible communications received from the Pytch system.
A watch may need to be paired with the appropriate Team ID before receiving team communications.
Users are responsible for verifying that watches are properly paired, sufficiently charged, and functioning before use.
Pytch transmitters connect compatible mobile devices to the Pytch wireless communication system.
Users are responsible for confirming the correct Team ID, Bluetooth connection, battery level, and device configuration before use.
Certain transmitter models may provide additional functions such as compatible wireless phone charging. Charging performance depends on the connected device, alignment, battery level, and supported charging standards.
Pytch may provide mobile applications for controlling or configuring Pytch products.
You are granted a limited, personal, non-exclusive, non-transferable, and revocable license to use the application solely in connection with the Pytch Services.
You may not copy, sell, sublicense, redistribute, reverse engineer, or commercially exploit Pytch software except where applicable law expressly permits such activity.
Pytch products may receive software or firmware updates that:
Features may evolve over the life of a product.
You are responsible for installing required updates when necessary for continued compatibility, security, or functionality.
Where a Pytch product is advertised as requiring no subscription, Pytch will not require a recurring Pytch communication subscription merely to use the advertised core communication functionality of that product.
This does not prevent Pytch from offering optional paid products, accessories, services, premium features, or future products separately.
Third-party services used with Pytch products may have their own fees or requirements.
Rules governing electronic communication devices can differ between leagues, associations, tournaments, schools, conferences, and sanctioning organizations and may change over time.
Unless Pytch Sports expressly states otherwise in writing, the purchase or possession of a Pytch product does not guarantee that the product is approved for use by a particular league, tournament, school, association, or governing body.
The coach, team, school, organization, and user are responsible for confirming that use of Pytch equipment is permitted under the rules applicable to their competition.
Pytch Sports is not responsible for penalties, disqualifications, protests, or other consequences resulting from use of a device where its use is prohibited or restricted.
Pytch products are communication tools.
You may not use the Services to:
We may suspend access to Services when reasonably necessary to protect users, our systems, or the integrity of the Pytch platform.
The Pytch name, Pytch Sports name, product names, logos, designs, software, firmware, graphics, website content, documentation, and other proprietary materials are owned by Pytch Sports, LLC or its licensors and are protected by applicable intellectual-property laws.
Purchasing a Pytch product does not transfer ownership of Pytch intellectual property.
No Pytch trademark, logo, product design, software, documentation, or other proprietary material may be reproduced or commercially used without permission except as permitted by law.
Pytch products may interact with third-party smartphones, operating systems, Bluetooth technology, charging standards, applications, accessories, or other services.
Pytch Sports does not control third-party products or services and cannot guarantee that third-party changes will never affect compatibility.
Third-party products and services are subject to their own terms and policies.
We attempt to make product descriptions, photographs, specifications, pricing, and other information accurate.
However, minor differences may occur between photographs, prototypes, illustrations, software screens, packaging, and production products.
We may correct typographical errors, inaccuracies, or omissions.
Any hardware warranty offered with a Pytch product is governed by the written warranty accompanying the product or published by Pytch Sports.
Except for warranties expressly provided by Pytch Sports and warranties that cannot legally be excluded, the Services are provided on an “as is” and “as available” basis to the fullest extent permitted by applicable law.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PYTCH SPORTS, LLC AND ITS MEMBERS, MANAGERS, EMPLOYEES, CONTRACTORS, AND AFFILIATES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO THE SERVICES.
THIS MAY INCLUDE LOSS OF PROFITS, LOSS OF DATA, LOSS OF BUSINESS OPPORTUNITY, INTERRUPTION OF PLAY, MISSED OR DELAYED COMMUNICATIONS, OR COMPETITIVE CONSEQUENCES.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PYTCH SPORTS' TOTAL LIABILITY ARISING FROM A PRODUCT PURCHASE WILL NOT EXCEED THE AMOUNT PAID TO PYTCH SPORTS FOR THE PRODUCT OR SERVICE GIVING RISE TO THE CLAIM.
Some jurisdictions do not permit certain exclusions or limitations, so portions of this section may not apply to you.
Pytch products should not be used in a way that distracts a player, coach, driver, equipment operator, or other person where distraction could create a safety risk.
Inspect wearable devices and accessories before use and discontinue use of damaged equipment.
Use of the Services is also subject to the Pytch Sports Privacy Policy.
The Privacy Policy explains how we collect, use, store, and protect information associated with our Services.
We may suspend or terminate access to online Services when reasonably necessary because of:
Termination does not affect rights or obligations that arose before termination.
We may update these Terms as our products, Services, or legal obligations change.

These Terms are governed by the laws of the State of Oklahoma, without regard to conflict-of-law principles, except where applicable consumer law requires otherwise.
If any provision of these Terms is found unenforceable, the remaining provisions will continue in effect to the fullest extent permitted by law.
These Terms, together with applicable policies, warranties, and other terms presented during purchase or use of the Services, constitute the agreement between you and Pytch Sports concerning the subject matter they cover.
